Bombay HC reserves Kangana Ranaut’s plea seeking ‘quashing of criminal defamation

The Bombay High Court on Wednesday reserved its verdict for the plea made by Kangana Ranaut which was a response to a complaint filed by Javed Akhtar earlier last year. Javed Akhtar lyricist and poet, filed a complaint last year alleging that Ms Ranaut made defamatory statements on national and international television, ‘in what appears to be a clear campaign to malign and tarnish Akhtar in the eyes of the general public.’ After which further proceedings took place in Andheri’s magistrate court in February and Raunat was issued a bailable warrant in March. The actress appeared in front of the magistrate and was issued bail.

During July of this year, Ranaut filed a plea in the High court challenging the entire proceeding, including summons and orders issued to date. Advocate Rizwan Siddiquee representing the actress argued with the following statement, “The magistrate has to be master of investigation himself and record reasons, and cannot just pass orders mechanically. No material evidence was brought on record by the complainant (Akhtar) and the material was brought by a third party and the same was not examined on oath. However, the magistrate relied on it. He was duty-bound to determine the veracity of the complaint.

On the other hand, Jay Bharadwaj opposed the plea by stating that the magistrate followed all the procedures and also added that in order for the investigation to be impartial, all people involved need to be summoned, but Ranaut never made an appearance in the court.

The Court concluded the hearing and reserved the appeal for order, which is likely to be pronounced on September 9.
