A special court under the Narcotic Drugs and Psychotropic Substances (NDPS) Act has ordered the defreezing of Riya Chakraborty’s bank accounts. Bank accounts were frozen by the Narcotics Control Bureau (NCB) last year after being booked in a drugs case following the death of actor Sushant Singh Rajput in June.
In her petition for closure of her bank accounts, Rhea Chakraborty stated that she is ‘an actor/model by profession‘ and ‘NCB froze the bank accounts and FDs without any reason vide notice dated 16/09/2020‘ and it is doing grave injustice.
Her application states that the bank account is required to be operated to pay the salaries of her employees and to meet various tax liabilities including GST payments etc. The actress said that she supports her lifestyle with the amount in bank accounts. Her brother is also dependent on him. She said that her bank accounts were closed for 10 months, and it was creating prejudice for her, therefore, they should be closed.
Special Public Prosecutor Atul Sarpande, representing the NCB, opposed the application, saying that the financial probe in the matter was going on and it was not completed yet. Sarpande protested that if the accounts are defrosted, it would hamper the investigation.
It was further argued that if the bank accounts are defrosted, the said amount has a high probability of getting involved in drug mafia and drug-related business. Therefore, he sought dismissal of the application. However, the investigating officer in the matter said that it would be better to leave the matter to the discretion of the court.
Special Judge DB Mane said, “From the reply of the Investigating Officer, it appears that there is no strong objection on the part of the NCB to freeze the bank accounts and FDs of Chakraborty. The judge further said, “In such circumstances, Chakraborty is entitled to dispose of the bank accounts and FDs subject to conditions and undertaking backed by an affidavit stating that during the course of the hearing of the case and the conclusion of the trial, that balance as shown in the concerned account on 16/09/2020, available for passing necessary orders, if required.”
In another petition, Rhea Chakraborty demanded that her gadgets, MacBook Pro, Apple Laptop and Apple iPhone, be returned. Atul Sarpande said that the material has been confiscated and sent to the laboratory and now they have got the same from the laboratory.
It is further submitted that the investigating officer has already informed the actress to collect her assets. The court ordered that after proper verification and identification, the gadgets be returned to Riya on the ‘supername‘ and an indemnity bond of Rs 1,00,000 be executed.
